Welcome to bizarr platform, an online platform that allows artisans specializing in handicrafts and arts showcase and market their artistic creations. The platform also provides an opportunity for suppliers of raw materials supporting artisans to display their products. By registering on the platform, users acknowledge reading and fully accepting the terms and conditions and agree to comply with all stated provisions, including applicable laws and platform-related directives.
1. Definitions
Platform: Refers to bizarr electronic platform, including its website and associated applications.
Artisan/Merchant/Supplier: A user who showcases and sells their products through the platform.
User: Any person who utilizes the platform, whether as an artisan, supplier, or buyer.
Products: Handcrafted works or raw materials offered for sale on the platform.
Orders: A transaction by which a buyer purchases products through the platform.
Agreement: Refers to the terms and conditions set forth in this document.
Contract: An agreement governing the relationship between the platform and the artisan, concluded through a confirmation number sent via text messages.
2. Legal Capacity
1. The user must have reached the legal age of majority (18 years) and have full legal capacity to conduct commercial transactions through the platform.
2. If the user represents a commercial entity, they must:
2.1 Be legally authorized to bind the entity to these terms and conditions and provide relevant information regarding the entity, including but not limited to (the commercial registration, national address, trade type, and entity representative).
2.2 Acknowledge that their entity possesses the legal, regulatory, and legitimate capacity to conduct commercial activities through the Albazar. The user further agrees that in case of a violation of this clause, they assume full legal responsibility towards third parties, including other users. The platform bears no responsibility for any transactions between the user and other parties. The platform reserves the right to hold the user accountable under contractual and tort liability, seeking compensation for any damages, including reputational harm to the platform before consumers, users, or other parties.
2.3 Provide the platform with all necessary documentation, such as the commercial registration and any other documents requested for registration and verification of the legal identity of the store.
3. Platform Services
3.1. The platform provides a digital environment that enables merchants to showcase and sell their handmade products effectively to a wide audience of users.
3.2. The platform is responsible for marketing products using various promotional tools, that enhance product visibility and attract targeted customers.
3.3. The platform facilitates communication between artisans, suppliers, and buyers, supporting online sales and purchases.
3.4. The platform streamlines payment processes through secure and reliable payment gateways, ensuring efficient order completion, thereby enhancing the user experience and helping merchants effectively market their products.
3.5. The platform offers suppliers an opportunity to showcase and sell raw materials and supplies that support artisans.
3.6. The platform provides additional services to users, such as guidance and advisory support.
3.7. All platform services are subject to the terms and conditions set forth in this user agreement, with specific provisions applying to each service without derogating from the general provisions of this agreement.
3.8. The platform provides merchants and users with various shipping options based on different weights.
4. Obligations of the Parties
4.1. Platform Obligations
4.1.1. The platform commits to providing a secure environment that allows merchants to showcase and sell their products easily, ensuring a reliable and suitable experience for all parties.
4.1.2. The platform undertakes to process financial transactions accurately and is responsible for transferring profits to the merchant’s account after deducting any applicable commission.
4.1.3. The platform is committed to offering customer support services to merchants and buyers throughout the week, addressing inquiries, and resolving any technical or financial issues that may arise.
4.1.4. The platform is obligated to implement measures to protect the personal data of merchants and buyers and to refrain from using such data for external purposes.
4.1.5. The platform provides necessary updates to ensure efficient and stable operation and promptly addresses any technical malfunctions that may impact its performance.
4.1.6. The platform is not obligated to guarantee sales results or revenue generation; its commitment ends with enabling the user to benefit from the features and solutions available through in the platform.
4.1.7. Ensure the quality of the products and their conformity with the description, and the product is published on the platform within (8) hours after conformity.
4.1.8. All orders are followed up by the platform's tracking department, and in the event of failure, the merchant is alerted.If the merchant fails three times, the platform has the right to close the store and delete the products.
4.1.9. The platform must provide after-sales support services and clarify any additional conditions related to maintenance or repairs when necessary.
4.2. Merchant Obligations
4.2.1. The merchant must provide an accurate and up-to-date national address and promptly update it in the event of any changes.
4.2.2. If the merchant represents a legal entity (such as a company or establishment), they must submit the necessary documentation, including commercial registration and national identification.
4.2.3. The merchant bears responsibility for the accuracy and validity of all personal and financial information provided during registration and must update it regularly.
4.2.4. The merchant agrees to comply with all applicable local laws and regulations, including consumer protection and intellectual property laws.
4.2.5. The merchant is obligated to offer original and high-quality products that match the descriptions and images provided on the application. Additionally, the merchant must provide accurate and honest descriptions of their products, including specifications, dimensions, and materials used.
4.2.6. The merchant is responsible for managing their inventory and continuously updating their data to ensure the availability of products listed on the application.
4.2.7 The merchant must ship the product within (48) hours from the time the product is ready.
4.2.8 The merchant must adhere to the agreed-upon schedule for order delivery and update shipment statuses to enable buyers to track their orders.
4.2.9 The merchant is committed to the period specified and entered by him in the program if it is handmade.
4.2.10The merchant is committed to delivering the products and services displayed on the application with seriousness and diligence, ensuring product availability and timely delivery.
4.2.11. All products offered by the merchant must be original and match the description and pictures attached in the application, to ensure that the product matches the customer’s expectations, taking into account providing an accurate description of each product, including the materials used, dimensions, and manufacturing method. If the product differs from the written description, the product will be canceled, and the merchant will be notified.
4.2.12. The merchant is required to maintain honesty and integrity in all transactions conducted through the application, including providing accurate product information and adhering to fair dealing standards in all interactions with customers and the platform.
5. Account
5.1. The user must create a dedicated account through the application to display their products. The user is obligated to provide accurate and truthful information and link a valid bank account. The user must notify the platform of any changes to their information within a specified period (24 hours).
5.2. All users must disclose the required data on their profile page as specified by the platform. If it is found that the data is inaccurate or not promptly updated, the platform reserves the right to suspend or disable the user’s account.
5.3. The platform reserves the right to refuse services or suspend/cancel a merchant’s account in case of any violation of these terms, submission of inaccurate or misleading information, or use of their account in any way that damages the reputation of the application or violates the applicable laws in Kingdom of Saudi Arabia as determined by the platform’s criteria. The merchant also has the right to cancel their account at any time but must be responsible for settling any outstanding financial obligations.
5.4. The platform has the right to disable any user account if they violate the eligibility provisions of this agreement. It may take any measures it deems appropriate, including canceling membership based on its discretion or in compliance with court orders or legal judgments.
5.5. The merchant alone is responsible for maintaining the confidentiality of their account data, including the password, and agrees not to allow anyone to use their account. The merchant must take all necessary precautions to keep their password secure and must immediately notify the application if they suspect that their password has become known to anyone.
5.6. The user’s profile must comply with the laws and regulations of Saudi Arabia. The user must clearly define their business activities and the type of services or products they provide or sell.
5.7. The platform disclaims any liability for violations of the laws of Saudi Arabia or public morals. It reserves the right to refuse activation of any electronic page that does not comply with applicable laws, regulations, or the terms of this agreement.
5.8. The user is obligated to adhere to all applicable laws, regulations, and provisions in Saudi Arabia, including but not limited to the E-Commerce Law, the Anti-Cyber Crime Law, and the Electronic Transactions Law.
5.9. The user acknowledges that before registering on the platform, they verified that they meet all necessary procedures and requirements mandated by the official authorities in Saudi Arabia and have completed all these procedures and requirements to conduct their activity.
6. Product Terms
6.1. All products listed on the platform must be original and comply with approved specifications and standards listed in "What to sell on bizarr" page
6.2. The merchant is fully responsible for the quality and suitability of the products, as well as their conformity to the descriptions and details advertised on the platform.
6.3. The sale or display of products that violate local laws or Islamic Shari’a principles, including prohibited, counterfeit, or fake items, is strictly prohibited.
6.4. The merchant must provide accurate and up-to-date information about the products, including weight, size, ingredients, and expiration date.
6.5. The platform reserves the right to remove any product that violates the terms or harms the reputation of the platform or its users.
6.6. All shipped products must be appropriately packaged and photo captured to ensure their protection during shipping and delivery and future complains.
6.7. In the event of a dispute regarding a product, the resolution will be handled in accordance with the platform’s procedures.
7. Communication and Interaction
7.1. The user agrees to be contacted via email or through public messages broadcast by the platform to all users or specific users upon logging into their accounts. The user acknowledges that all electronically sent agreements and notifications constitute valid legal evidence.
7.2. Users must adhere to respectful communication and mutual courtesy in all interactions.
7.3. During the user’s membership and activity on the platform, the platform will send electronic messages to notify them of any changes, procedures, or new promotional campaigns added to the platform.
8. Amendments to Terms and Conditions
8.1. The user acknowledges and agrees that the platform reserves the right to amend this agreement at any time, potentially increasing obligations or reducing rights relating to the use of the platform, based on amendments to this agreement.
8.2. The user will be notified of any modifications through available technical means, which may include email or general messages to all users upon logging into the platform. Continued use of the platform by the user after such amendments constitutes acceptance of the changes and agreement to be bound by the amended terms.
8.3. The user agrees that the platform has the absolute authority to make any substantive or minor modifications to this agreement without incurring any legal liability. User acceptance of these amendments becomes legally binding once they are notified through available technical means, and continued use of the platform following these modifications constitutes their acceptance of the changes.
8.4. If the user objects to any modification of the terms of use, they may be unable to access their account. The user must accept the agreement and any amendments to continue using the platform’s services.
9. Service Fees and Profit Sharing
9.1. The platform is entitled to impose a commission on every sale transaction conducted through it. The commission rate is specified in the merchant’s settings page and any changes to the rate will be communicated in advance.
9.2. Before deducting taxes, the merchant is entitled to receive 75% of net profits, while the platform retains 25% as compensation for covering all payment-related costs and expenses, which include but are not limited to (cost of bank, cost of installments, service cost, and ant other costs related to transaction).
9.3. Payments are processed through secure payment gateways provided by the application. After deducting the applicable commission, the remaining amounts are transferred to the merchant’s wallet within ten (10) business days from the purchase date.
9.4. All users acknowledge and are fully aware that the management of monetary transactions related to their commercial activities on the platform is subject to the authority and regulations of the Saudi Central Bank. As such, the platform indicates that some funds transfers may be delayed due to restrictions imposed by the Central Bank, the Ministry of Commerce, and e-commerce regulations governing electronic sales and purchases.
9.5. All fees are calculated in Saudi Riyals unless otherwise stated. Suppliers must pay all due fees in addition to any other expenses imposed by the platform, which are payable using the payment methods specified and approved by the platform.
9.6. Not all platform services are free for users; some services are subject to varying fees. The platform reserves the right to impose fees on users.
9.7. The platform reserves the right to add, increase, reduce, or deduct any fees or expenses in accordance with the rules and terms of the user agreement for any users, regardless of the reason for their registration.
10. Intellectual Property Rights
10.1. All content on the platform, whether electronic or otherwise, written or illustrated, including but not limited to: texts, designs, technical ideas, logos, presentations, button icons, symbols, audio clips, aggregated data, and software, is owned by the platform and its rights are reserved. No individual has the right to use any of it in any form, whether direct, indirect, or through a third party.
10.2. All these rights are protected under intellectual property and trademark laws, and they are exclusively owned by the platform. No infringement or unauthorized use is allowed without express permission from the platform management or its owners.
10.3. The user grants the platform the right to use images and product descriptions published by the user for promotional and marketing purposes within the application and its associated social media platforms.
10.4. The user is committed to respecting the intellectual property rights of the platform and other users. They must ensure that displayed products are their own or that they have the rights to sell them. The publication of any material that violates the intellectual property rights of others is strictly prohibited.
10.5. The platform will take necessary measures to address any violations or infringements of its intellectual property rights.
10.6. The platform management respects the intellectual property rights owned by users.
10.7. For promotional and marketing purposes, the platform has the right to use the trademarks owned or licensed to users, or any other content shared by the user on the platform.
11. Liability
11.1. Platform Liability
11.1.1. The platform bears no responsibility for any direct or indirect damages incurred by the merchant as a result of using the application, including but not limited to loss of profits, damages caused by technical malfunctions, or account breaches.
11.1.2. The platform is in no way responsible for any unsatisfactory or delayed performance by merchants, shipping companies, payment gateways, banks, or non-compliance by buyers, nor for any losses, damages, or delays due to unavailable goods, delayed delivery, or poor quality of services provided by suppliers.
11.1.3. The platform is not liable for any claims arising from user errors or negligence, whether directly, indirectly, incidentally, or through a third party.
11.1.4. The platform is not liable for any claims or responsibilities resulting from misuse, abuse, inability to use, or misappropriation of the platform. The platform assumes no liability in such cases.
11.1.5. The platform is not liable for any claims, disputes, costs, damages, or responsibilities resulting from actions taken by platform users or malicious acts by third parties.
11.1.6. The platform has no association with any unlawful or unauthorized activities conducted by users or any actions contrary to Saudi laws and regulations.
11.1.7. The user acknowledges that displaying, selling, or distributing counterfeit, fraudulent, or intellectual property-infringing products constitutes a violation of the law, subject to legal penalties. In case of such a violation, the user bears full responsibility for any consequences.
11.1.8. The platform is not a seller of the products displayed on it and is not a seller’s agent, nor does it guarantee or ensure the quality of displayed products. In case of a dispute between the supplier and the customer, neither party has the right to seek compensation or redress from the platform.
11.2. Merchant Liability
11.2.1. The merchant undertakes and undertakes to produce a commercial register or self-employment document.
11.2.2. The user is solely responsible for any harm caused to the platform, its employees, owners, or affiliates due to their violations.
11.2.3. The user is obligated to prevent and remedy any harm to the platform, its employees, or any of its affiliates resulting from claims, losses, damages, costs, or expenses incurred due to misuse or violations of the user agreement, Saudi laws, or infringement of the rights of other users or third parties.
12. Store Closure
12.1. The user has the right to request the closure of their account registered in the platform’s database. Upon making such a request, certain documents must be provided, such as, but not limited to: a closure request signed by the supplier’s legal representative and authenticated by official authorities.
12.2. The platform reserves the right to accept or reject the closure request and to claim any rights or outstanding financial dues owed by the store.
12.3. Without prejudice to the terms of this agreement, if the user submits a request to close their account, they will not be eligible for any refunds on active subscriptions.
12.4. When evaluating a store closure request, the platform will take care to prevent any disruption to the fulfillment of supply agreements concluded through the platform.
13. Warranties
13.1. The platform does not guarantee the repair of defects or that supplier-provided products are free of other defects. The supplier is responsible for warranty coverage if mentioned, and its duration in the product description. The supplier must commit to providing high-quality products in their online store.
13.2. The merchant guarantees the quality of their products and their conformity with the descriptions and images provided, including any specified warranty and its duration stated in the product description.
13.3. The buyer must review the warranty terms for the product and cannot assume the existence of any warranty unless explicitly stated by the supplier.
14. Dispute Resolution
14.1. In accordance with the rules and terms of this user agreement, disputes shall be resolved through reconciliation, negotiation, or amicable settlement. If the dispute persists, it shall be resolved by the competent authorities in Saudi Arabia, with exclusive jurisdiction granted to the courts of Riyadh.
15. Complaints
15.1. Upon registration on the platform, users acknowledge reading and fully accepting the terms and conditions and agree to comply with all stated provisions, including applicable laws and platform-related guidelines.
15.2. In the event of a complaint from one user against another, the platform encourages adherence to the following procedures:
15.2.1 Submitting a complaint via the designated link on the platform, including the text of the complaint, supporting documents, and the name of the violating user. will then forward the complaint to the concerned user for resolution.
15.2.2 If the complainant is dissatisfied with the response, they have the right to request a copy of the supplier’s legal identification to take any necessary further actions.
15.3. The complainant may take any appropriate actions after reviewing the response from the user against whom the complaint was filed.
16. General Provisions
16.1. It is required that all products offered by the merchant be craft, artistic, and hand-made products by the merchant himself, and that the products must be original, coming from the merchant and of high quality.
16.2. This user agreement is governed by and construed in accordance with the laws, regulations, and legislation in force in Saudi Arabia and is fully subject to the applicable legal framework of the Kingdom’s authorities.
16.3. If any provision or clause of this agreement is annulled or becomes invalid, this shall not affect the validity of the remaining provisions, which shall remain in full force until further notice from the platform management.
16.4. If the user agreement is translated into any other language, whether on the platform or elsewhere, the Arabic version shall remain the authoritative text for all transactions.
16.5. Users will be notified of any amendments to this user agreement. Continued use of the platform constitutes acceptance of any modifications.
16.6. This user agreement may only be annulled or modified through a decision issued by the platform.
